GENERAL CONDITIONS OF SALE 
These General Conditions of Sale (hereinafter also General Conditions) have as their object the discipline of the purchase of Products, carried out remotely, via the electronic network, from the site https://www.granucciseats.com (hereinafter, the Site) .
The owner of the site is Tai Ji di Granucci Giovanni, later Granucciseats.com

1. Acceptance of the General Conditions of Sale
1.1 All purchases of Products made through the Site by the user who access it (also defined below, the Customer) are governed by these General Conditions in accordance with the provisions of Part III, Title III, Chapter I, Consumer Code (D Legislative Decree No. 206/05 as amended by Legislative Decree No. 21/14 and Legislative Decree 70/03).
1.2 Before accessing the Products provided by the Site, the Customer is required to read these General Conditions of Sale which are generally and unequivocally accepted at the time of purchase.
Therefore, the Customer is invited to download and print a copy of the purchase form and these General Conditions of Sale, the terms of which can be changed unilaterally by Granucciseats.com at any time and without notice.
1.3 The General Conditions published on the Site at the time of the sending of the purchase order by the Customer will apply to the Purchase Agreements.
2.User / Customer
2.1 The Customer undertakes to follow the instructions on the Site and to provide his / her personal data correctly and truthfully.
2.2 The confirmation will in any case release Granucciseats.com from any responsibility for the data provided by the Customer who undertakes to promptly inform of any variation of their communicated data.
2.3 If the Customer provides incorrect or incomplete or untrue data, Granucciseats.com will have the right not to activate or to suspend the service until the relative deficiencies are remedied.
3.Treatment of personal data
The Customer's data are processed in accordance with the provisions of the personal data protection legislation, as specified in the specific section containing the information pursuant to art. 13 Legislative Decree June 30, 2003 (privacy Policy). 
4. Definition of the order
4.1 https://www.granucciseats.com is a telematic sales site for motorcycle accessories, in particular Saddles, Seat covers, Comfort seat cushions, (hereinafter, the Products) manufactured by Granucciseats.com in Italy.
4.2 All the products on this site are the result of craftsmanship and therefore may be subject to variations between one piece and another. It should be noted that, since they are handmade products, any imperceptible product discrepancies will not be considered production defects, but a guarantee of the authenticity and uniqueness of the product itself. The products are NO e-marked.The seats do not generally need homologation.For countries where it is required for road traffic, it is the customer who must inquire before purchasing. Granucci seats declines all responsibility.
4.3 The Customer can purchase the Products in the electronic catalog illustrated on the home page of the Site https://www.granucciseats.com within the respective sections by product category, as described in the relevant information sheets contained on the Site, respecting the technical access procedures illustrated therein.
4.4 The publication of the Products displayed on the Site constitutes an invitation addressed to the Customer to formulate a contractual purchase proposal pursuant to art. 1336 c.c.
4.5 The order sent by the Customer has the value of a contractual proposal and implies full knowledge and full acceptance of these General Conditions.
4.6 The visual representation of the Products on the Site, where available, normally corresponds to the photographic image of the Products themselves and has the sole purpose of presenting them for sale, without any guarantee or commitment, by Granucciseats.com regarding the exact correspondence of the image depicted on the Site with the actual Product and this, with particular regard to its actual dimensions and / or packaging.
The colors and processes of the materials represented must be considered as general and approximate indications of the Product and not binding with respect to the Product delivered.
4.7 In the event of a difference between the image and the written product sheet, the description of the product sheet prevails.
4.8 Granucciseats.com reserves the right to make changes to the products on sale without prior notice.
4.9 The site includes new accessories for motorbikes and scooters of own production, there are no articles of other brands or for third parties on sale.
5. Prices
5.1 The prices are those published on the Site and are exclusively in Euro (€) and include VAT, net of transport costs.
5.2 The prices are subject to change at any time.
5.3 The changes will not affect orders for which the order confirmation has already been sent.

6.Spedizioni
The shipment takes place by private courier both in Italy and abroad.
6.1 Shipping costs, except for any promotions, are always charged to the Customer and are explicitly highlighted at the time of placing the order.

6.2 Shipping costs are not included in the published price and are highlighted at the time of the order or request and will be invoiced separately.

6.3 The cost of each shipment may vary according to the method of delivery and payment as well as the destination.

6.4 Packaging is free

6.5 Upon delivery of the Product by the courier in charge, the Customer is required to check that the packaging is intact.

6.6 If the package is damaged, the Customer can express a reservation, before signing the document, he must write "I accept with reserve right because the package has the following anomaly" (describe the damage that is observed on the package).
In this case, if once the package has been opened, there is any damage to the purchased product deriving from transport, the courier must respond.

6.7 If the package is tampered with (open) the Customer can express to the carrier the unacceptability of the package due to tampering and "refuse the package due to tampered with neck".
If the customer does not carry out these operations, he considers the package regularly delivered.

6.8 We ship within the times communicated within the product sheet and / or the response form.

6.9 In the event of force majeure, unavailability of means of transport, strikes, unforeseeable or inevitable events that cause a delay in deliveries, and / or in any case any reason that makes deliveries difficult or impossible or that cause a significant increase in the delivery cost charged of Granucciseats.com will entitle the same to postpone and / or cancel, in whole or in part, the delivery or to terminate the Purchase Agreement.
In such cases, Granucciseats.com will provide timely and adequate communication of its decisions to the email address indicated by the Customer who will be entitled to a refund of the price paid, excluding any further claim in any capacity against Granucciseats.com
 
6.10 Delivery is deemed completed when the Product is made available to the Customer at the address indicated in the order form.

6.11 In case of non-delivery due to the absence of the recipient at the specified address, the courier will send an e-mail or a text message and will attempt delivery the next day.
In case of impossibility to carry out the delivery also the following day due to the absence of the recipient, the Customer Service will try to contact the Customer to schedule a new delivery. If the Customer Service is unable to contact the Customer for the next 10 days or due to the impossibility of delivery due to the absence of the recipient, the Products covered by the order will be returned to Granucciseats.com which will intend the order canceled and will return the sum paid except for round-trip shipping costs.
Pursuant to art. 54 of the Consumer Code, the Products that are available in the warehouse of Granucciseats.com will generally be delivered: (a) in Italy and in the EU Member States other than Italy, within the 10th working day following receipt
of the order by Granucciseats.com and no later than the deadline established by law from the receipt of the payment.
 

7. Purchase method
7.1 All the products offered are illustrated in detail on the home page of the Site, within the respective sections, divided by Product categories, Granucciseats.com does not sell used or third party items.
The customer can only purchase products present in the electronic catalog at the time of placing the order and viewable online.

7.2 For immediate orders the confirmation message will indicate an "Order Number" to be used in any subsequent communication with Granucciseats.com.
The message will re-propose, in addition to the information required by law, all the data entered by the customer who undertakes to verify its correctness and to communicate any possible correction.
Any increase in costs caused by errors in the data not reported promptly will be charged to the Customer.
The contract stipulated between Granucciseats.com and the customer must be considered concluded with the customer's acceptance of the conditions of sale.
7.3
For some categories of more complex items to avoid incorrect purchases before concluding the order, the customer must complete the form to conclude the purchase contract for one or more products.

7.5 Once the online purchase procedure is concluded, the customer will print or save an electronic copy and in any case keep these general conditions of sale, in compliance with the provisions of Legislative Decree 206/05 (consumer code).
7.6 Each order will be shipped accompanied by a regular Packing List, the Commercial Invoice will be sent only if expressly requested at the time of the order.
8.Pagamento
8.1 The payment of the purchased products and the relative shipping costs must be made by the customer in these ways: Paypal, Bank Transfer, Cash on delivery (only if approved)
8.2 PayPal: for immediate orders (see point 7.2) the Customer at the time of payment will be directed to the secure Paypal page to proceed with the payment.
For orders received via the form (see point 7.3) if the customer chooses this type of payment, we will send the payment request directly to the e-mail address indicated by the customer in the request form from the Paypal website.
8.3 Bank Transfer: the Customer must pay the total amount within 7 working days of making it
beyond the date, the order will be considered void.

The reason to be reported on the bank transfer must indicate the date of the order, the company name or name of the buyer and the number of the order or item purchased.

8.4 Cash on delivery, (only if approved) is valid only for purchases arriving from Italy.
Payment by Cash on Delivery which involves an additional fixed cost is to be made to the courier upon delivery of the product in cash or by check made payable to the courier, if accepted by the latter.
9. Availability of Products
9.1 The availability of the products refers to the actual one when the buyer places the order,
this availability must however be considered purely indicative since, due to the simultaneous presence on the Site of several Customers, the Products could be sold to another Customer before confirming the order and also after sending the confirmation e-mail of the order, there may be cases of partial or total unavailability of the goods.
In this case, the customer will be informed immediately via e-mail.
9.2 Granucciseats.com has the right to accept or not, at its own discretion, the order sent by the Customer, without the latter being able to make claims or rights of any kind, for any reason, including compensation, in case of non-acceptance of the order itself.
9.3 In particular, Granucciseats.com reserves the right not to accept purchase proposals and cancel orders that do not give sufficient guarantees of solvency or if, even after comparison with the circuit that manages credit card payments, anomalies in the transactions occur and in the means of payment used by the Customer.
10. Passage of risk
10.1 The risks related to the Product, such as loss or damage will be borne by Granucciseats.com from the moment of delivery to the courier if the carrier has been chosen by Granucciseats.com
 10.2 The risks related to the Product, such as loss or damage will be borne by the Customer from the moment of delivery to the courier if the carrier has been chosen by the Customer and this choice has not been proposed by Granucciseats.com, without prejudice to the consumer's rights towards of the carrier.
11.Reservation of ownership
The products that have been sent to the customer remain the property of Granucciseats.com until the customer has fully paid the price, including shipping costs.
12. Data protection
The purchaser's data are processed in accordance with the provisions of the personal data legislation, as specified in the specific section containing the information pursuant to art.13 EU Regulation 2016/679 (Privacy Policy)
13. Obligations of the Buyer
13.1 The Buyer undertakes to pay the price of the purchased goods in the times and ways indicated in the contract.
13.2 The Purchaser undertakes, once the purchase procedure is concluded, to print and / or keep this contract.
13.3 The information contained in this contract has, however, already been viewed and accepted by the Buyer, who acknowledges it, as this step is made mandatory before the purchase confirmation.

13.4 Il cliente ha l'obbligo di leggere e attenersi alle istruzioni di manutenzione allegate all'articolo acquistato.
13.5 Per le selle e le copertine-rivestimenti per selle il Cliente deve eseguire o far eseguire da un professionista una installazione corretta ed il motociclo non deve essere stato modificato rispetto all'originale, così come evidenziato nella nostra proposta di vendita,perché in questo caso la sella acquistata potrebbe non applicarsi correttamente sul motociclo e nel tempo danneggiarsi.
13.6 Per le selle,copertine e/o rivestimenti delle selle e i cuscini non vanno usate per la pulizia sostanze aggressive ma solo detergenti a base di acqua e sapone neutro. 
14.Garanzia 
14.1 Se il Cliente ha stipulato il contratto in qualità di consumatore ovverosia qualsiasi persona fisica che agisca sul sito per scopi estranei all’attività imprenditoriale e/o professionale eventualmente svolta, la presente garanzia è valida a condizione che il difetto si manifesti entro 24 mesi dalla data di consegna del Prodotto; che il Cliente presenti reclamo formale in merito ai difetti entro un massimo di due mesi dalla data in cui il difetto è stato dal Cliente riconosciuto.
14.5 Trattandosi di prodotti artigianali, eventuali impercettibili difformità del prodotto non saranno considerate difetti di produzione, ma garanzia dell’autenticità e dell’unicità del prodotto stesso (vedi punto 4.2 delle presenti Condizioni Generali).Inoltre i colori e le lavorazioni dei materiali rappresentati devono essere considerati come indicazioni generali e approssimative del Prodotto e non vincolanti rispetto al/ai Prodotto/i consegnato/i"(vedi 4.6 delle presenti Condizioni Generali)
14.7 Escluso che il difetto esposto non rientri nei punti 13.4-13.5-13.6-14.5-14.6  delle presenti Condizioni Generali Granucciseats.com è responsabile per qualunque difetto del Prodotto offerto sul Sito ai sensi di quanto disposto dalla normativa italiana.Il Cliente concorderà con Granucciseats.com se preferisce il ripristino, se possibile, del bene, il rimborso o la sostituzione del bene non conforme.
14.8 Ogni reso dovrà essere prima sempre autorizzato da Granucciseats.com via email.
Prima di procedere al reso il Cliente deve inviare una e-mail a info@granucciseats.com completa dei dati utili ad identificare l'acquisto (nome,cognome,indirizzo,articolo acquistato,data di acquisto,eventuale numero ordine) spiegando il problema e allegando alcune foto esplicative.
14.9 Se sarà valutato che il difetto è dovuto a un problema di fabbricazione il Cliente ha diritto al rimborso o alla sostituzione del bene acquistato.
Il Cliente dovrà utilizzare la busta o la scatola con la quale Granucciseats.com ha spedito gli articoli, oppure qualsiasi altra scatola di cartone delle dimensioni utili a contenere il prodotto da restituire. Il Servizio Clienti comunicherà al Cliente le modalità di rimborso,è esclusa qualsiasi responsabilità ulteriore a qualunque titolo di Granucciseats.com 
15. Diritto di recesso (D. Lgs. n. 21/2014 di recepimento della Direttiva 2011/83/UE)
15.1 Conformemente alle disposizioni legali in vigore (Codice del Consumo), il Cliente ha diritto di recedere dall’acquisto senza alcuna penalità e senza specificarne il motivo, entro il termine di 14 giorni solari decorrenti dalla data di ricezione dei prodotti.
15.2 Il Cliente che intende esercitare il diritto di recesso dovrà comunicarlo a  Granucciseats.com anche con una semplice e-mail .
 15.3 La merce dovrà essere spedita o restituita a: Granucci seats,via Dalmazia 44,21100 Varese ,dovrà essere restituita integra, nella confezione originale, completa in tutte le sue parti e completa della documentazione annessa. 
Verificata l’integrità del Prodotto, Granucciseats.com potrà procedere al rimborso della somma pagata per l'acquisto dei Prodotti comprese le spese di consegna di cui al Contratto di Acquisto oggetto del recesso entro un termine massimo di 14 giorni .
15.4 Il Cliente si fa carico del costo di restituzione dei beni. Con il rimborso del bene le parti del presente contratto sono sciolte dai reciproci obblighi.
Quando possibile il rimborso verrà effettuato con lo stesso mezzo di pagamento scelto dal Cliente.
Nel caso di pagamento effettuato tramite bonifico, l’Utente dovrà fornire le coordinate bancarie :IBAN,Swift e BIC necessari all’effettuazione del rimborso.
15.5 L’articolo restituito deve essere necessariamente non usato, in caso contrario la richiesta di reso non potrà essere accettata. Utilizzare la busta o la scatola con la quale Granucciseats.com ha spedito gli articoli, o qualsiasi altra scatola di cartone delle dimensioni utili a contenere il prodotto da restituire.
 Attenzione: le spese di spedizione per il reso sono a carico del cliente.

14.Garanzia
14.1 If the Customer has entered into the contract as a consumer or any natural person acting on the site for purposes unrelated to any business and / or professional activity carried out, this guarantee is valid provided that the defect occurs within 24 months from delivery date of the Product; that the Customer makes a formal complaint about the defects within a maximum of two months from the date on which the defect was recognized by the Customer.
14.5 Being artisan products, any imperceptible discrepancies of the product will not be considered production defects, but a guarantee of the authenticity and uniqueness of the product itself (see point 4.2 of these General Conditions). In addition, the colors and workmanship of the materials represented must be considered as general and approximate indications of the Product and not binding with respect to the Product / s delivered "(see 4.6 of these General Conditions)
14.7 Excluding that the exposed defect does not fall within points 13.4-13.5-13.6-14.5-14.6 of these General Conditions Granucciseats.com is responsible for any defect of the Product offered on the Site in accordance with the provisions of Italian law. The Customer will agree with Granucciseats .com if you prefer to restore, if possible, the good, refund or replace the non-conforming good.
14.8 Each return must first be authorized by Granucciseats.com by email.
Before proceeding with the return, the Customer must send an e-mail to info@granucciseats.com complete with data useful for identifying the purchase (name, surname, address, item purchased, date of purchase, order number, if any) explaining the problem and attaching some explanatory photos.
14.9 If it is assessed that the defect is due to a manufacturing problem, the Customer is entitled to a refund or replacement of the purchased good.
The Customer must use the envelope or box with which Granucciseats.com shipped the items, or any other cardboard box of the size useful to contain the product to be returned. The Customer Service will inform the Customer of the refund procedures, any further liability for any reason of Granucciseats.com is excluded
15. Right of withdrawal (Legislative Decree no. 21/2014 transposing Directive 2011/83 / EU)
15.1 In accordance with the legal provisions in force (Consumer Code), the Customer has the right to withdraw from the purchase without any penalty and without specifying the reason, within the term of 14 calendar days from the date of receipt of the products.
15.2 The customer who intends to exercise the right of withdrawal must communicate it to Granucciseats.com also with a simple e-mail.
 15.3 The goods must be sent or returned to: Granucci seats, via Dalmazia 44,21100 Varese, must be returned intact, in the original packaging, complete in all its parts and complete with the attached documentation.
Once the integrity of the Product has been verified, Granucciseats.com will be able to refund the amount paid for the purchase of the Products including the delivery costs referred to in the Purchase Agreement subject to withdrawal within a maximum period of 14 days.
15.4 The customer takes care of the cost of returning the goods. With the reimbursement of the goods, the parties to this contract are released from their mutual obligations.
When possible, the refund will be made with the same payment method chosen by the customer.
In the case of payment made by bank transfer, the User must provide the bank details: IBAN, Swift and BIC necessary for making the refund.
15.5 The returned item must necessarily be unused, otherwise the return request cannot be accepted. Use the envelope or box with which Granucciseats.com shipped the items, or any other cardboard box of the size useful to contain the product to be returned.
Attention: the shipping costs for the return are charged to the customer.
16. Jurisdiction
These terms of use and sale are regulated by Italian law.
In case of disputes relating to the interpretation and execution of the contracts stipulated in adhesions to these general conditions, the competent court will be that of Varese.
